Terms of Service

1. GENERAL PROVISIONS

These Terms of Service (hereinafter referred to as the "Terms") govern access to and use of the Nano Banana 2 service, available at nanobanana.expert (hereinafter referred to as the "Service"). By using the Service, you confirm that you have read and fully accept these Terms.

If you do not agree with these Terms, please discontinue use of the Service immediately.

2. DESCRIPTION OF THE SERVICE

Nano Banana 2 is a platform for generating images using artificial intelligence. The Service enables users to create images based on text descriptions (Text-to-Image) and edit images using references (Image-to-Image).

3. REGISTRATION AND USER ACCOUNT

3.1. Registration is required to use the paid features of the Service. You must provide accurate information during registration.

3.2. You are fully responsible for maintaining the security of your account credentials (login and password) and for all activities carried out using your account.

3.3. If you discover unauthorized use of your account, you must immediately notify the Service administration at hello@nanobanana.expert.

3.4. The Service administration reserves the right to suspend a user account without prior notice in the event of a violation of these Terms.

4. PAYMENT AND VIRTUAL CURRENCY

4.1. Image generation uses a virtual currency called "Bananas" (🍌). Bananas are not legal tender, electronic money, or a payment instrument under the laws of the Russian Federation.

4.2. The banana balance is replenished by purchasing packages denominated in Russian Rubles through the YooKassa payment service.

4.3. The cost of generating a single image depends on the selected model, resolution, and the pricing system in effect at the time of generation.

4.4. Purchased bananas are non-refundable, except as required by the applicable consumer protection laws of the Russian Federation.

4.5. The Service administration reserves the right to modify package prices and pricing unilaterally with at least 3 (three) days' prior notice to users.

5. ACCEPTABLE USE

5.1. You may use the Service solely for lawful purposes and in accordance with these Terms.

5.2. The following is prohibited:

— generating images containing sexual violence, child exploitation, or pedophilia;

— creating images that promote violence, terrorism, extremism, incitement to hatred, or discrimination based on race, ethnicity, religion, gender, or other characteristics;

— infringing the rights of third parties, including copyrights, related rights, and trademarks;

— generating defamatory, discrediting, or libelous material about individuals or legal entities;

— using the Service for fraud or any other illegal activity;

— attempting to gain unauthorized access to the servers or databases of the Service;

— making automated requests that bypass established limitations.

5.3. The Service administration applies request filtering to prevent the creation of prohibited content.

6. CONTENT RIGHTS

6.1. All images generated through the Service are provided to the user for personal use.

6.2. Images created by the user are automatically deleted from the Service servers 14 (fourteen) calendar days after creation.

6.3. The Service administration does not claim ownership of user-generated images; however, it reserves the right to remove content that violates these Terms.

7. LIABILITY

7.1. The Service is provided "as is." The administration does not guarantee uninterrupted or error-free operation of the Service.

7.2. The administration shall not be liable for any indirect, incidental, or punitive damages arising from the use of or inability to use the Service.

7.3. The administration shall not be liable for the quality of generated images or their conformity to the user's expectations.

7.4. The aggregate liability of the administration to the user is limited to the amount paid by the user for the Service within the preceding 30 days.

8. PERSONAL DATA

The processing of users' personal data is carried out in accordance with the Privacy Policy, which constitutes an integral part of these Terms, and in compliance with Federal Law No. 152-FZ dated July 27, 2006, "On Personal Data."

9. AMENDMENTS TO THE TERMS

The administration reserves the right to amend these Terms unilaterally. The current version is always available at nanobanana.expert/terms. Continued use of the Service after the publication of changes constitutes your acceptance of the updated Terms.

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Russian Federation. All disputes shall be resolved by the courts at the location of the Service administration.
